2. ELECTRONIC COMMUNICATIONS
Retail Flag communicates with its customers, sellers and every member electronically. Our communication with you shall vary in its ways, such as email, text, applications other than the website and many other ways including email messages. This document shall act as an agreement between you and us authorizing us to communicate with you through legal electronic and print media resources.
3. COPYRIGHT, AUTHORS' RIGHTS AND DATABASE RIGHTS
All the content on the website such as logos, buttons, images or any other form of data is the property of Retail Flag or its sellers/content suppliers. Illegal extraction or usage of any such data, which belongs to Retail Flag, is not allowed without our prior consent. International copyright and database right laws and the local laws such as PECA and other applicable laws protect the data and content on the website or any other channel, which is related to Retail Flag. No data shall be extracted by using robots or any other tools for that matter without our prior consent. Utilization of the content and data on Retail Flag is also protected by all applicable laws.
4. TRADEMARKS
Intellectual Property rights protect our trademarks. Usage of any of our trademarks on the service not related to Retail Flag is not permitted. All other trademarks that appear on Retail Flag are the property of their owners who may or may not be affiliated with Retail Flag.
5. LICENCE AND ACCESS
Subject to your compliance with all the conditions specified on this page, Retail Flag and its content providers allow you to access, make personal and commercial use of Retail Flag Services. However, the access is limited, non-exclusive, and non-transferable. As per the agreement, resale or any other commercial/private use of any of Retail Flag’s services is prohibited. Any access which is not granted to you by this electronic system is reserved by suppliers, publishers, right holders or any other stakeholder of Retail Flag. Retail Flag is protected by country’s local laws and you shall not try to gain access to any unauthorized feature. In case you desire to request access, then follow the specified guidelines.
7. YOUR ACCOUNT
Your
account and password details are solely your responsibility. You also agree to
take all the responsibility of any kind of use of your account. You shall
ensure that the password for the account is kept safe and let us know in case
of any security issues. All the details you provide us must be correct and you
are also liable to inform us timely in case of any changes in the information
you provide us.
You
shall not use Retail Flag or its services in any form which is damaging or
impairing our brand and services. All such usage including any unlawful
activity is prohibited and protected by the state laws.
We reserve the right to amend, terminate or block your access to your account in case of any breach of the policy and the guidelines.
8. REVIEWS, COMMENTS, COMMUNICATIONS AND OTHER CONTENT
As a visitor, you are allowed to post reviews, comments and all other content which is allowed to you. However, it is your responsibility to ensure that the content you post is not abusive, threatening, defamatory, obscene or in contradiction with any law as specified by the state (s) or any other regulatory authority or policies of Retail Flag. Giving false information or impersonation is also an offense and is punishable by local laws. The content you post on the website in shape of comments, reviews and feedbacks is the property of Retail Flag and we reserve the right to use that content as and when we require. We reserve the right to terminate this contract and block your access to your account in case of any breach. Your content shall not violate Intellectual property rights or other rights of any other third party. 9. INTELLECTUAL PROPERTY CLAIMS
We respect intellectual property rights of every individual and entity. If you feel that your intellectual property rights are violated in any way then please do not hesitate to contact us.
11. OTHER BUSINESS
Third parties sell their products on Retail Flag. Retail Flag ensures that only authentic sellers are allowed to sell their products on the platform. However, while doing a transaction, you are responsible to carefully read and understand the details and any specific terms mentioned by the third parties. Retail Flag does not warrant the offerings of any party other than Retail Flag itself.
12. RETAIL FLAG'S ROLE
Retail Flag is an electronic market place where we connect the buyers and sellers through safe and secured payment gateways. We are neither the buyers nor sellers rather a platform where you complete your e-commerce transactions. We keep your payment secured until you receive the order and only disburse it afterwards.
13. OUR LIABILITY
Retail Flag will make its paramount effort to ensure that the services provided to you are uninterrupted and without any error. Nevertheless, we may require to troubleshoot, enhance or upgrade our system. For this reason, we reserve the right to suspend or restrict your access to our services from time to time as and when require.
However,
we commit to you that we shall ensure the minimum frequency of such suspensions
and restrictions.
Retail
Flag will not be responsible for:
Any
loss which is not caused by any breach on our part
Any
kind of business loss
Indirect
or consequential loss that is unforeseeable to you and us.
Retail
Flag will not be responsible for an error or delay which is caused by anything
which is beyond our rational control. However, you reserve your legal right to
receive services, payments/refunds, products and all other associated services
within a reasonable time provided such services be not beyond our specified
control. Local state laws might vary from country to country and all those laws
are applicable to you while you avail our services.
The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights. Moreover, these conditions do not affect our responsibility to prevent fraudulent representations by us or avoid any loss to a person or property by our negligence or willful misconduct.
14. APPLICABLE LAW
All local laws as defined by State of Islamic Republic of Pakistan are applicable to you and us. In case any international law has an extra binding on any of the parties, the same law should be implemented and followed.
15. ALTERATIONS TO SERVICE OR AMENDMENTS TO THE CONDITIONS OF USE
Retail Flag reserves the right to alter/change its services, policies, terms and conditions including these Conditions of Use and Service Terms at any time. You will be subject to the regulations applicable at the time you use our service.
16. WAIVER
Retail Flag reserves the right to take no action for the time being if you breach any of these conditions. We can exercise our right later as and when required.
17. CHILDREN
Retail Flag sells children’s products to be purchased by adults. If you are not 18 you may use our services with the consent of your parent or guardian only.

19. NOTICE AND PROCEDURE FOR MAKING CLAIMS OF RIGHT INFRINGEMENTS
If you feel that your rights are violated then you may contact us through contact form on CONTACT US page. We will take all such issues seriously and take appropriate action. If you notify us for any such issue, Retail Flag may take certain actions within our rightful domain. When you submit a notice, you grant us the right to publish, use, modify, translate, reproduce, create derivative works from and display the content of that notice anywhere in the world as we deem fit.
Note on Third Party Listings: Please keep in mind that third party listings are posted solely at the discretion of third-party sellers and all of them are accessible via their listings. Retail Flag is only hosting their listings and for product and other details you may contact them directly.
RFI Defined: "RFI" stands for Retail Flag Identifier (or Identification) Number and is a ten (10) character identifier. It can be found below any listing under Product Details. RFI can also be considered the identity number for a specific page. If you want to file a complaint, then kindly refer to RFI, and mention that in your case.

20. NOTICE AND PROCEDURE FOR NOTIFYING RETAIL FLAG OF DEFAMATORY CONTENT
Multiple vendors and sellers are listing their products on Retail Flag
therefore it is not possible for us to keep a check on every single comment,
post or review. In case you feel anything is defamatory and in violation with
any regulation as defined in this agreement, you may contact us through contact
form on CONTACT US page.

ADDITIONAL RETAIL FLAG SOFTWARE TERMS
Use
of the Retail Flag Software. You may use Retail Flag Software solely for purposes of enabling
you to use and enjoy the Retail Flag Services as provided by Retail Flag, and
as permitted by the Conditions of Use, these Software Terms and any Service
Terms. You may not incorporate any portion of the Retail Flag Software into
your own programs or compile any portion of it in combination with your own
programs, transfer it for use with another service, or sell, rent, lease, lend,
loan, distribute or sub-license the Retail Flag Software or otherwise assign
any rights to the Retail Flag Software in whole or in part. You may not use the
Retail Flag Software for any illegal purpose. We may cease providing any Retail
Flag Software and we may terminate your right to use any Retail Flag Software
at any time. Your rights to use the Retail Flag Software will automatically
terminate without notice from us if you fail to comply with any of these
Software Terms, the Conditions of Use or any other Service Terms. Additional third-party
terms contained within or distributed with certain Retail Flag Software that
are specifically identified in related documentation may apply to that Retail
Flag Software (or software incorporated with the Retail Flag Software) and will
govern the use of such software in the event of a conflict with these Conditions
of Use. All software used in any Retail Flag Service is the property of Retail
Flag or its software suppliers and protected by local laws.
Use
of Third Party Services. When you use the Retail Flag Software, you may also be using the
services of one or more third parties, such as a wireless carrier or a mobile
provider. Your use of these third-party services may be subject to the separate
policies, terms of use, and fees of these third parties.
No
Reverse Engineering. Unless explicitly permitted under applicable mandatory law, you
may not, and you will not encourage, assist or authorize any other person to
copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper
with, the Retail Flag Software, whether in whole or in part, or create any
derivative works from or of the Retail Flag Software.
Updates. In order to
keep the Retail Flag Software up-to-date, we may offer automatic or manual
updates at any time and without notice to you.
